Continuous Evaluation for the AI That Makes the Ad, Picks the Audience and Drafts the Story

AxiSentinel extends continuous AI compliance evaluation to advertisers, agencies, ad tech platforms, publishers, broadcasters and newsrooms: the AI that generates the creative, clones the voice, picks the audience, scores brand safety, measures the campaign and drafts the story, evaluated against the AI, copyright, advertising, privacy and media rules of every market the ad runs in and the story reaches.

What's Changing

Advertising and Media Just Became an AI Governance Problem

Advertising and media were among the first industries to put generative AI to everyday use: the image in the banner, the voice in the spot, the audience segment, the brand-safety score and the first draft of the story. Until recently none of it was regulated as AI. In 2025 and 2026 labelling law, copyright courts, targeting rules and media law all arrived at once.

Aug 2025
General-Purpose AI Duties and the European Media Freedom Act Apply
From 2 Aug 2025, providers of the models behind generative ad and newsroom tools must keep an EU copyright policy and publish a training-content summary on the Commission’s template. From 8 Aug 2025, the European Media Freedom Act protects media content on very large platforms and sets rules for audience measurement.
Sep 2025
China Requires Labels on AI-Generated Content
Measures issued by the CAC and three other authorities, with a mandatory national standard, require visible labels and metadata labels on AI-generated text, images, audio and video from 1 Sep 2025.
Oct 2025
EU Political Advertising Regulation Applies
From 10 Oct 2025, political ads must carry labels and transparency notices, targeting with personal data needs explicit consent, and sponsors from outside the EU are barred in the three months before an election. Fines reach 6% of annual worldwide turnover.
Nov to Dec 2025
German Courts Draw the Line on Training Data
On 11 Nov 2025 the Munich Regional Court held that song lyrics memorised by a model are reproduced in it, outside the text-and-data-mining exception. On 10 Dec 2025 the Hamburg Higher Regional Court held a plain-language opt-out was not machine-readable for a 2021 dataset download.
Jun 2026
Synthetic Performers Must Be Disclosed in New York Ads
From 9 Jun 2026, advertisers must conspicuously disclose a synthetic performer they know is in an ad. On 10 Jun 2026 the European Commission published its Code of Practice on marking and labelling AI-generated content.
Jul 2026
Court Approves $1.5B Bartz v. Anthropic Settlement
Final approval on 20 Jul 2026 of about $3,000 per book for more than 400,000 works, after a 2025 ruling that building a training library from pirated copies was not fair use. Training-data provenance is now a balance-sheet question.
Aug 2026
AI Labelling Duties Go Live in Europe and California
From 2 Aug 2026, EU AI Act Article 50 requires deepfakes and AI-written public-interest text to be labelled, and the Commission can fine general-purpose AI providers. The California AI Transparency Act requires large generative AI providers to embed provenance disclosures in images, audio and video.
Sep 2026
Third Circuit Rejects Fair Use for AI Training on Westlaw Headnotes
The appeals court affirmed that ROSS Intelligence infringed Thomson Reuters’ headnotes and could not claim fair use for copying them to train its AI.
Advertising and media crossed from a creative question into an AI governance problem the moment regulators and courts started asking what the model was trained on, whether the audience knew the content was synthetic, and who the ad was allowed to reach.

The coverage gap

Creative tools, ad platforms and measurement vendors each report on their own systems. No one evaluates the whole chain, from training data to the published asset to the impression served, with evidence a regulator, a court or a client would accept.

Every rule that touches an ad, an audience or a story

Advertising and media AI sits under AI law, copyright law, advertising and consumer law, privacy law and media law, in every market a campaign runs and a story reaches. AxiSentinel tracks every layer and builds RegDef packages the moment a rule is stable enough to evaluate against.

European Union
EU AI Act: General-Purpose AI & Transparency
Live Binding

The first horizontal AI law reaches the generative models agencies and newsrooms build on, and the content they publish in the EU.

  • General-purpose AI, since 2 Aug 2025: a copyright policy that respects rights reservations and a public training-content summary on the Commission template; a voluntary Code of Practice was published 10 Jul 2025.
  • Enforcement, since 2 Aug 2026: Commission fines for model providers up to 3% of worldwide turnover or €15M, whichever is higher.
  • Transparency, since 2 Aug 2026: deepfakes must be disclosed, and so must AI-generated text published to inform the public on matters of public interest unless it has had human review and editorial responsibility.
  • Machine-readable marking: required for new generative systems from 2 Aug 2026; systems already on the market have until 2 Dec 2026.

Digital Services Act: Advertising Rules
Live Binding

Every online platform that shows ads must tell users, for each ad, that it is an ad, on whose behalf it runs, who paid and the main targeting parameters.

  • No ads profiled on sensitive data: profiling with special-category data such as health, religion or sexual orientation cannot be used to target ads (Article 26).
  • No profiling-based ads to minors: where the platform is reasonably certain the user is a minor (Article 28).
  • Ad repositories: very large platforms keep searchable records of ads, their targeting and their reach (Article 39); X was fined €120M on 5 Dec 2025, partly for its repository.
AxiSentinel coverage: tracked, RegDef package build scheduled.
European Union
Political Advertising Regulation (EU) 2024/900
Live Binding

Fully applicable since 10 Oct 2025 to sponsors, publishers and providers of political advertising services.

  • Labels and notices: every political ad identifies its sponsor and the amount paid, and discloses the audience targeted.
  • Targeting limits: online targeting or ad delivery using personal data only under strict conditions, including explicit consent.
  • Penalties: up to 6% of annual worldwide turnover; a public EU repository will hold online political ads for seven years.
AxiSentinel coverage: tracked, RegDef package build scheduled.
European Union
European Media Freedom Act
Live Binding

Applies since 8 Aug 2025 to media service providers reaching EU audiences and to the very large platforms that carry their content.

  • Protected media content: media providers that declare, among other things, that they do not publish unreviewed AI-generated content get notice and 24 hours to reply before a very large platform restricts their content (Article 18).
  • Audience measurement: systems must be transparent, impartial, non-discriminatory and verifiable, and proprietary methodologies audited once a year (Article 24).
AxiSentinel coverage: tracked.
European Union
GDPR, ePrivacy & the Ad Tech Consent Chain
Live Binding

Audience modelling, lookalikes and programmatic bidding all process personal data, and Europe’s courts have tested the consent framework the industry runs on.

  • Consent signals are personal data: the Court of Justice held on 7 Mar 2024 that the TCF consent string is personal data.
  • Joint control: on 14 May 2025 the Brussels Market Court found IAB Europe a joint controller for the consent signals and upheld its €250,000 fine.

Copyright: Text-and-Data-Mining Opt-Outs
Live Appeals Pending

Article 4 of the DSM Copyright Directive allows commercial text and data mining unless rightsholders reserve their rights in a machine-readable way.

  • GEMA v. OpenAI, 11 Nov 2025: the Munich Regional Court held lyrics memorised in a model are reproduced in it and outside the mining exception; the ruling is not final.
  • Kneschke v. LAION, 10 Dec 2025: the Hamburg Higher Regional Court upheld the mining defences and found a terms-of-service reservation not machine-readable for a 2021 download; appeal to the Federal Court of Justice allowed.

Copyright and Generative AI Training
Live Litigation Ongoing

Fair use is being decided case by case, and the outcomes now carry a price.

  • Copyright Office Part 3 report, 9 May 2025: no bright-line rule; outputs that substitute for originals and knowing use of pirated works weigh against fair use.
  • Thomson Reuters v. ROSS: fair use rejected in Feb 2025 and affirmed by the Third Circuit in Sep 2026.
  • Bartz v. Anthropic: $1.5B class settlement given final approval on 20 Jul 2026; The New York Times’ case against OpenAI and Microsoft continues.

FTC Act, Reviews Rule & Operation AI Comply
Live Binding

The FTC applies existing deception law to AI claims, AI-made endorsements and AI-generated reviews.

  • Operation AI Comply, 25 Sep 2024: five enforcement actions against deceptive AI claims and schemes.
  • Consumer Reviews Rule, since 21 Oct 2024: bans fake reviews and testimonials, including AI-generated ones, and fake social media indicators bought from bots.
  • Penalties: up to $53,088 per violation.

State Likeness, Synthetic Performer & Provenance Laws
Live Binding

States regulate the voices, faces and provenance data that generative advertising depends on, while a federal digital-replica bill stalled in the Senate on 30 Sep 2026.

  • Tennessee ELVIS Act, since 1 Jul 2024: publicity rights extend to a simulated voice, with liability for tools built to imitate an identifiable person.
  • New York synthetic performer law, since 9 Jun 2026: conspicuous disclosure in ads; $1,000 for a first violation, $5,000 for each after.
  • California AI Transparency Act, since 2 Aug 2026: large generative AI providers embed provenance disclosures in images, audio and video, at $5,000 per violation per day; large platforms follow from 1 Jan 2027.

United Kingdom & Denmark
ASA Guidance & Danish Deepfake Bill
Guidance Bill Introduced

Two European markets outside the AI Act’s labelling rules are setting their own lines for AI in ads and synthetic likeness.

  • UK CAP Code: ASA guidance of June 2026 confirms the code applies however an ad is made, AI depictions of real people must not imply an endorsement, and automated tools do not shift responsibility.
  • Denmark: a copyright amendment introduced on 8 Oct 2026 would ban sharing realistic deepfakes of a person’s face or voice without consent, with satire and parody exempt; the government hopes it applies from early 2027.

Asia-Pacific
China, Korea & India AI Content Labelling
Live Binding

Asia’s largest advertising markets already require AI-generated content to be labelled.

  • China, since 1 Sep 2025: visible labels and metadata labels on AI-generated text, images, audio, video and virtual scenes.
  • Korea AI Basic Act, since 22 Jan 2026: generative AI output labelled, with clear notice for realistic sound, images and video.
  • India IT Rules, since 20 Feb 2026: synthetically generated content labelled with provenance markers on intermediaries.
AxiSentinel coverage: tracked in the regulatory map.

For Investors

An assurance category advertising and media AI has never had

Advertising and media run on AI decisions made at enormous scale every day, and the rules governing those decisions arrived in the same eighteen months. AxiSentinel’s architecture already does this for software AI; advertising and media are a new RegDef surface on the same platform, not a new product.

The commercial logic, stated plainly

  • Labelling is now law in the largest markets: the EU, China, Korea, India and California all require AI-generated content to be marked or disclosed, and advertising and media produce that content at industrial scale.
  • Provenance has a price: a $1.5B settlement, a German memorisation ruling and a US appellate decision on AI training have made training-data and rights records a financial question, not a legal footnote.
  • Targeting rules keep narrowing: the DSA, the Political Advertising Regulation and GDPR case law restrict who can be targeted and on what data, and each rule needs evidence per impression.
  • Evidence is the defense: when a regulator, a rightsholder or a client asks how an asset was made and who saw it, the answer is a record. That record is exactly what AxiSentinel produces.
  • Compounds with existing verticals: the same evidence that covers a client’s synthetic-media, platform and election AI extends across a full agency, ad tech or newsroom stack at effectively zero incremental engineering cost.
  • TIC industry precedent: a $254B+ inspection and certification industry has never had a platform for continuous AI assurance across creative, targeting and editorial systems.

The honest risk picture

  • Accreditation in process.
  • Advertising and media RegDef packages are tracked, not yet built. DSA advertising, Political Advertising Regulation, European Media Freedom Act, California AI Transparency Act and Asian labelling packages depend on guidance, standards and repository timing outside AxiLayer’s control.
  • The copyright and likeness landscape is still moving. GEMA v. OpenAI and Kneschke v. LAION are on appeal, The New York Times’ case against OpenAI continues, the federal NO FAKES Act has stalled and Denmark’s deepfake bill is still before parliament.
